Militant group welcomes end of VFA despite wrong reason for its termination




The militant Partido Manggagawa (PM) today welcomed the termination of the Visiting Forces Agreement (VFA) with the United States despite it being ended by President Rodrigo Duterte as a retaliation for the cancellation of the visa of ally Senator Bato dela Rosa.

“Militant workers and women workers do not shed a tear for the death of the VFA even if it was terminated for the wrong reason by President Duterte. We look forward to no more Jennifer Laudes killed and Nicoles raped by US soldiers in the Philippines,” stated Judy Ann Miranda, PM secretary-general.

PM was active in the campaign for justice for Nicole, the accuser in the so-called Subic rape case by a US Marine in 2005. Then in 2014, another US Marine killed transgender Jennifer Laude in Olongapo.

Miranda averred that “Moreover, we demand that aside from the VFA, the Mutual Defense Treaty and the Enhanced Defense Cooperation Agreement be abrogated too. We stand for an independent foreign policy founded on preserving and protecting our country’s sovereignty and national interest, and cooperation with other nations on the basis of common concerns.”

The termination of the VFA and other pressing social issues in the country will be the subject of an assembly by PM this afternoon. More than a hundred union, urban poor, women and youth leaders in the NCR, Calabarzon and Central Luzon are meeting in QC Memorial Circle for a discussion of the national situation. PM is also celebrating its 19th anniversary.

Miranda added that “We would have wanted President Duterte to tear up the VFA because he stood up for Philippine sovereignty. But that is wishful thinking of a President who also cannot defend our country against China’s incursions.”

“Those who argue that the VFA is needed to defend ourselves from China are wrong. The VFA did not stop China from militarizing the West Philippine Sea. It is not war or warmongering that will resolve the WPS dispute. Instead the Philippines needs to muster a coalition of Southeast Asian nations for a multilateral agreement on the WPS,” Miranda explained.

The group also took to task the senators who are trying to save the VFA. “It would have been better if these senators had agreed with the termination of the VFA on the right basis of advancing Philippine sovereignty. But again it is too much to ask of these weak-kneed politicians. Apparently their loyalty to Tatay Digong ends where their loyalty to Uncle Sam begins,” Miranda insisted.

DFA request for Pemberton custody is pabalat-bunga, lacks weight of a sovereign state

The Partido Manggagawa (PM) viewed the effort of the Department of Foreign Affairs (DFA) to request custody of Lance Corporal Joseph Scott Pemberton, prime suspect in the killing of transgender woman Jeffrey “Jennifer” Laude, as insincere or “pabalat-bunga” since pleading for it through a ceremonial letter lacks the weight of a sovereign state.

“The DFA was basically pleading to get back the sovereignty we lost under the Visiting Forces Agreement (VFA). And the most stupid thing is to do it now is through a formal request,” said PM spokesman Wilson Fortaleza.

In the first place, Fortaleza argued, the DFA was not expecting US approval of its request because prior to commission of any crime by American soldiers, the government has already agreed to the provision that gave US the right to retain custody of its personnel involved in crimes in Philippine soil. 

According to PM, the request was rather intended to pacify growing criticisms over a kind of foreign policy blunder that borders on outright surrender if not patent subservience to a colonial master. 

Until said provision is deleted from the VFA, including other devious provisions in favor of US interest, Filipinos cannot expect justice for the likes of Jennifer, and would-be victims of American soldiers in Philippine soil. 


PM added that the Philippines can effectively get hold of Pemberton only if it acts like a free nation and its foreign policy presided not by a certified Amboy. PM, together with other militant groups, is calling for the scrapping of the VFA and the Enhanced Defense Cooperation Agreement (EDCA) between the Philippines and the United States.

Labor party demands turnover of US Marine suspect in transgender killing

Partido Manggagawa (PM) condemns the killing of transgender woman, Jeffrey Serdoncillo Laude a.k.a. Jennifer Laude, allegedly by a US Marine participating in the Balikatan exercise in Olongapo City 11p.m. of October 11.

PM expressed its readiness to mobilize its women and LGBT members and coordinate with other groups in a fight to seek justice for Laude. The group had also been active in the Nicole Subic rape case campaign.

According to reports, the US embassy had issued a statement assuring its full cooperation with Philippine law enforcement authorities.  The same commitment was expressed by the US government during the hearing of “Nicole” in the Subic rape case, but in the end convicted rapist Daniel Smith was allowed to escape by Philippine authorities in collusion with the US embassy.

“It has been almost three days yet both suspect and probable witnesses remain in the custody of American authorities in Philippines soil,” declared PM Secretary General Judy Ann Miranda. She added that “Similar to our demand during the trial of the Subic rape case, custody of suspect should in the hands of Philippine authorities.”

The group insists that nothing justifies Laude’s killing. “Being gay, hiding the fact that he is gay or being a prostitute does not make Laude’s killing right,” Miranda ended.

PM once more called for the repeal of the Visiting Forces Agreement under whose provisions the Balikatan exercises are conducted. “This recent incident again exposes that the VFA does not provide protection for Filipinos whose civil and social rights may be violated by US soldiers and moreover ties the Philippines to the imperialist agenda of the American government,” Miranda explained.


She furthered that ”We have nothing to gain and more to lose from allowing US soldiers, ships and planes to base in Philippine territory. An independent foreign policy is our best defense against external threats even against China’s claims on disputed islands.”

PM calls for scrapping of VFA in rally vs. US warship visit

The Partido ng Manggagawa called for the scrapping of the Visiting Forces Agreement in a rally at the US Embassy this morning against the visit of the aircraft carrier USS Carl Vinson. “The USS Carl Vinson is an instrument of American imperialist aggression and its visit makes the PNoy government an accomplice in US military adventures. Its docking in the waters just off the Mall of Asia recalls the Mock Battle of Manila Bay that signaled US colonization of the Philippines,” declared Renato Magtubo, PM chair.

PM joined the Scrap VFA movement in the rally and the groups appealed to the Senate to repudiate the controversial military access agreement with the US.

“Among other reasons, the VFA flaunts the Philippine Constitution which bans nuclear weapons in our country and mandates an independent foreign policy. The visit of the nuclear capable USS Carl Vinson which just came from the latest US military adventure in Pakistan with a unilateral raid against Osama bin Laden contradicts all these provisions of the Constitution,” Magtubo asserted.

He added “Imagine an agreement such as the VFA breaking the supreme law of the land and yet PNoy leads in defending the visit as allowed under the access agreement.”

PM had earlier voice suspicion at the hush-hush tour of the aircraft carrier by President Benigno Aquino III and his top officials last Saturday. The group believes that a top secret agenda was discussed and speculated that it may be about more concessions about American access to Philippines as per the VFA and increased US intervention in the war against Muslim insurgents as a follow through to bin Laden’s assassination.

PM also warned at a repeat of the Subic rape case with thousands of US servicemen having rest and recreation in the country until tomorrow.

“Malacanang had made much of the fact that many Filipino-Americans are serving as crew of the USS Carl Vinson. But if Carl Vinson, a segregationist and militarist who had served for 50 years as congressman from the southern state of Georgia, were still alive he would have raised a howl at African-Americans and Asian-Americans holding positions in the aircraft carrier,” Magtubo explained. He revealed that Vinson was a staunch defender of segregation in the Southern US even as the civil rights movement for blacks gained ground in the 1950’s.

PM raises suspicions on PNoy visit to US warship

The Partido ng Manggagawa (PM) expressed suspicion at the scrapping of Manny Pacquiao’s courtesy call at Malacanang for a hush-hush visit of President Benigno Aquino III and his top officials to a US aircraft carrier. “It appears that PNoy prefers playing little brown brother instead of honoring a Filipino boxing hero. Given the circumstances, his visit to the USS Carl Vinson cannot be an innocent tour. The Americans talked to PNoy about something they wanted to remain secret, out of earshot of the Filipino people and out of the prying cameras of the media” asserted Judy Ann Miranda, PM secretary-general.

The group reiterated its opposition to the VFA and support for its scrapping. Moreover it called for the passage of the Freedom of Information (FOI) bill in order to promote transparency in government and access to information by the people. PM is calling on the Senate to repudiate the VFA and on Congress to pass the FOI bill.

“Such a top secret agenda in the middle of the high seas could be anything from more concessions about American access to Philippines as per the Visiting Forces Agreement (VFA) to increased US intervention in the war against Muslim insurgents as a follow through to Osama Bin Laden’s assassination,” Miranda speculated.

She added that “It could have been understandable that since PNoy likes fast cars, he would also be obsessed with big ships. But the visit came at the invitation of the Americans not at PNoy’s insistence.”

“We cannot be faulted from assuming the worse due to the suspicious circumstances. This is a big issue despite Malacanang’s attempt to downplay the event as a tour and douse the fire of speculation about the incident,” Miranda furthered.

PM is preparing for protest actions against the four-day visit of the USS Carl Vinson. It also warned at a repeat of the Subic rape case with thousands of US servicemen due to have rest and recreation in the country.

Workers call on Sen. Santiago to abrogate VFA

The labor party-list group Partido ng Manggagawa (PM) called on Sen. Miriam Santiago to push for the abrogation of the controversial Visiting Forces Agreement (VFA). Renato Magtubo, chairperson of PM, stated that, “The American troops in the country have overstayed their welcome, they are now bwisitors. The soonest the GI Joes are out of the Philippines, the better. With several allegations of sexual harassment on the American troops, they are fast becoming known as a band of rapists.”

The group said that the workers welcome any move that will question the VFA. “It is a step in the right direction if Sen. Santiago moves for renegotiation of the VFA. But it is even better if she recommends the termination of the notorious VFA,” insisted Magtubo.

PM is questioning the fact that the VFA has allowed the permanent basing of the US troops in the country thus negating the gains of the removal of the former American bases in the early 1990’s. “Year in and year out, American troops are in several critical areas in Mindanao, essentially establishing permanent bases and facilities under the cover of the provisions of the VFA despite the prohibition in the Constitution,” argued Magtubo.

He added that “Like the former bases in Clark and Subic, the continued presence of US troops have spawned social problems as shown by the cases of Nicole and Vanessa. It has even worsened the scourge of corruption with anomalies in the Balikatan funds as exposed by Ltsg. Nancy Gadian.” PM was actively involved in the campaign to seek justice for Nicole.

“The war against the Abu Sayyaf and Jemaah Islamiyah cannot be used as an alibi for basing US troops in Mindanao for they are not supposed to be involved in combat or even advisory roles in a purely internal matter. In fact, the presence of US troops are inflaming Islamic insurgency since it serves as agitation for propaganda. It has to be remembered that Al Queda started and grew as a reaction to the basing of foreign, principally American, military forces in the Muslim holy lands of Saudi Arabia,” Magtubo elaborated.

Smith’s acquittal consummates betrayal of justice

Before fingers are pointed at Nicole again for doing a disservice to her own defense by virtue of her retraction and the choice for a normal life, we stand firm on our view that Daniel Smith’s acquittal merely consummates the betrayal of justice perpetrated by both the US and the Philippine governments.

It was a wanton betrayal of Philippine sovereignty when the Arroyo government gave up its jurisdiction over the convicted US criminal. Smith must have been very thankful to our Senate for ratifying the Visiting Forces Agreement which served as the latter’s strongest defense.

In particular, it was a wilful betrayal of a woman’s right when Nicole, the rape victim, found herself helpless from her own government. Nicole did fight, but found herself at the losing end upon seeing her violator live his sentence under the loving care of his own government. Nicole’s lawyer did fight, the women’s movement also did fight, but the Philippine government is neither on their and Nicole’s side.

So what do we expect from this kind of situation? Truly, this decision is not only a shameful rendition of how the rule of law is upheld in this country but also on how our foreign policy reverted back to colonial relations.

RP, US govt's behind Nicole's recantation to restore soured relations

Nicole’s recantation served as her visa to the US, and perhaps to a ‘greener’ pasture. The Partido ng Manggagawa (PM) expressed this view in reaction to a report that the rape victim terminated the service of her lawyer and left the country for good.

“We can only commiserate with Nicole for being a victim twice over,” said Judy Ann Miranda, PM’s secretary-general, lamenting further that in doing so the young lady from Zamboanga may have, in effect, forfeited her claim for justice against Daniel Smith and against a virtual ‘gang rape’ by the Philippine and US governments.

Miranda said that though PM respects the decision of Nicole since every woman has the right to decide over her own body and her own fate, the circumstances which pressured or forced her into a compromise is more telling than her decision to live a peaceful life.

“On the one hand the Arroyo administration’s surrogate stance against the US in pursuing Nicole’s case weakened the fight for ultimate justice, while on the other the US’ propensity to breach Philippine laws reduced Nicole into a little brown lady fighting against the world’s mightiest warlord,” said Miranda, adding that the two governments may have orchestrated this move "to restore soured relations."

Miranda, however, said the fight for justice remains very much alive within the women movement as this development simply transforms the fight into a political one –a fight for justice and sovereignty against US imperialism.

PM has been consistently behind Nicole and the women movement’s fight for justice against US serviceman Daniel Smith and on the campaign for the abrogation of the Visiting Forces Agreement.

“Unfortunately for Corporal Daniel Smith, Nicole’s recantation may be enough to confuse the bar of public opinion but it is not good enough to overturn a court’s conviction. And for Obama who might have thanked Gloria for assuring him of a status quo for the VFA when he called her up last week, unfortunately he dialed a person who does not represent the true sentiment of the Filipino people,” concludes Miranda. ###

Little brown brother and sister

Like a true little brown brother, Press Secretary Cerge Remonde was giddy with joy at the fact that US President Barack Obama called up Mrs. Gloria Macapagal-Arroyo. Since Remonde is simply her alter ego, we can surmise that GMA is no less thrilled and no less a little brown sister.

That US President Obama will on his own initiative call up GMA to push for the controversial Visiting Forces Agreement is no surprise. The VFA is utterly in the imperial interest of America and it is to be expected that Obama will ensure its continuation. Showing their slavish mentality, Malacanang officials are happy that their master called up to make certain its imperial bidding is done.

The VFA must be abrogated at the soonest possible time. It is not just a violation of the constitution but an affront to our sovereignty. It serves the American imperial agenda but infringes on Philippine national interests. The VFA is to blame for the fact that convicted rapist Daniel Smith remains a fugitive from Philippine justice.

Scrap the VFA now!

The secret VFA document exposed by Sen. Joker Arroyo is the latest in a string of arguments to hang the iniquitous agreement. The secret document is an insult that adds to the injury of Daniel Smith’s contempt of our justice system.

The VFA must be scrapped now. It was ratified by the Senate in 1999 and 10 years of an unequal treaty is much too long already. This secret document is slap in the face of the Philippine Senate and Filipino people since it was hidden from public knowledge. The Senate cannot waste any time in abrogating the VFA.

From the very start the VFA was one-sided. While it was approved by the Philippine Senate, the US Senate did not ratify it. Thus even its status as a bilateral treaty is questionable.

Now this secret document shows as clear as day that the VFA violates diplomatic principles of reciprocity and mutuality. An American GI who has committed a crime, like Daniel Smith, can enjoy the comforts of their embassy but a Filipino soldier can only be incarcerated in a US jail as provided for by this secret paper.

This episode of the VFA secret document and Daniel Smith’s case should be transformed into an opportunity to reorient out foreign policy. Just like how the global crisis and its deleterious impact on our economy should be an occasion for a paradigm shift in our economic model.

The VFA is no different from the unequal Military Bases Agreement and the WTO is similar to the neocolonial Parity Rights treaty. The military policy of the US seeks to advance its economic agenda not our national interests. It is high time to chart an independent foreign policy together with a development model predicated on local industrialization.
